1. About JATUAL PARIS and These Conditions of Sale
These Conditions of Sale apply to any sales of products or services (the "Products") that you may order from JATUAL PARIS using the website, digital applications, or by telephone via our client relations center (the "Sales Channels").
The "Selling Entity" that will sell the Products to you depends on your location and the specific operations handling your order:
- For transactions within the European Union and applicable regions: SDS Group s.r.o., having its registered offices at Tolstého 9, Bratislava 811 06, Slovakia. Registration ID: 47 445 46; VAT ID: SK2023908447.
- For transactions in the Rest of the World: JATUAL DIAMONDS DMCC, having its registered offices at Platinum Tower, Floor 8, Office 810, Jumeirah Lakes Towers, Dubai, UAE. Registration Nr: DMCC199566; Trading Licence: DMCC-930420.
(Collectively, "JATUAL PARIS", "we", "us", and "our").
Please read these Conditions of Sale carefully. By placing an order, you agree to be bound by these terms.
2. Purchasing Eligibility
Only individuals (and not legal entities) who (a) have reached the age of legal majority required to enter into contracts (eighteen in most countries); (b) have the legal capacity to enter into contracts; and (c) use a shipping address in the country or countries that we ship to, may order Products through the Sales Channels.
By placing an order, you represent and warrant that you are a bona fide end-user customer purchasing for your own or another's personal use and will not deliver, sell, or otherwise distribute our Products for commercial purposes.
3. Product Availability & Order Process
All orders placed through the Sales Channels are subject to availability and acceptance by us. Placing an item in your shopping bag does not guarantee availability. Your order is not confirmed until you receive a written Confirmation of Order & Shipment. We reserve the right to refuse, cancel, and terminate orders at any time on reasonable grounds, including but not limited to suspicion of fraud or violation of these Conditions of Sale.
4. Prices, Taxes, and Payment
All prices shown on the Product pages or quoted by the Client Relations Center are in the applicable currency. Taxes and shipping costs will be calculated and shown before you confirm your order.
- Payment Methods: We accept the methods of payment identified as part of the order process.
- Security Checks: You expressly authorize us to perform security checks to transmit or to obtain information about you to or from third parties, including but not limited to your payment card details, to authenticate your identity and validate your payment.
- Title Transfer: Title and risk of loss for the Products pass to you upon delivery, provided full payment has been received.
5. Shipping Policy
We accept orders for delivery globally, subject to specific country exclusions.
- Restrictions: We do not ship to Post Office Boxes (PO Boxes), hotels, or military bases.
- Signature Required: We require a handwritten or electronic signature by an adult at the nominated delivery address to confirm the delivery of each Product. If you have specified a recipient who is not you for delivery purposes (for example, as a gift), you understand and accept that evidence of a signature by such recipient (or a person at the delivery address) is evidence of delivery and fulfillment of the sale by JATUAL PARIS.
6. Returns and Exchanges Policy
We wish for you to be completely satisfied with your purchase. If you are not, you may return your Product subject to the conditions below.
A. Return Period
Products may be returned for a refund or exchange within 30 days from the date of delivery.
B. Return Process
To initiate a return, please contact us at customer@jatual.com.
- Online Returns: We provide complimentary pre-paid return shipping labels. You must use the provided label and our specified carrier to ensure the package is insured and tracked during transit.
- In-Store Returns: You may also return Products purchased online to eligible JATUAL PARIS boutiques, subject to the same quality control inspections as mailed returns.
C. Condition of Returned Products
Products must be returned in a new and unused state, in perfect condition, with all protective materials in place and tags and stickers attached to them (if applicable), as well as with the original JATUAL PARIS box and delivery package, including all accessories, certificates, and documents.
We will strictly verify that the returned Product satisfies these conditions. If the Product shows signs of wear, damage, or alteration, we reserve the right to refuse the return.
D. Non-Returnable and Restricted Items
The following limitations apply:
- High-Value Items: Merchandise priced at 40,000 (in the applicable currency) or higher is not eligible for a monetary refund. Such items may be eligible for exchange only, at the sole discretion of JATUAL PARIS, and must be authorized expressly by our Client Relations Center.
- Customized Items: Unless faulty, orders for Products that have been personalized, engraved, resized, or otherwise made to your bespoke specifications cannot be canceled and such Products cannot be returned for exchange or refund.
E. Refunds
- Original Purchaser Only: Refunds will be issued to the original form of payment used for the purchase. In no event will a person who has received the Product as a gift (a "Gift Recipient") be entitled to receive a cash refund. Gift Recipients may be entitled to an exchange or merchandise credit, subject to our discretion.
- Shipping Costs: Except where required by applicable law, original shipping costs are non-refundable.
7. International Guarantee & Warranty
A. Commercial Warranty (JATUAL PARIS International Guarantee)
In addition to your statutory rights, JATUAL PARIS provides a commercial warranty on all Jewelry purchased through our Sales Channels.
Duration
One (1) year from the date of delivery.
Coverage
This warranty covers all manufacturing defects and hidden defects in materials or workmanship confirmed by our technical experts.
Remedies
If a defect is found within the warranty period, JATUAL PARIS will, at its sole discretion:
- Repair the product free of charge; or
- Replace the product with an identical or comparable piece; or
- Refund the purchase price if repair or replacement is not feasible.
B. Exclusions from Warranty
The JATUAL PARIS International Guarantee does not cover:
- Normal Wear and Tear: Scratches, tarnishing, or the natural aging of materials (e.g., leather straps, rhodium plating wear).
- Accidental Damage: Damage resulting from accidents, drops, impacts, or negligence.
- Misuse: Damage caused by exposing the product to harsh chemicals, extreme temperatures, or use inconsistent with our Care Guide.
- Unauthorized Modifications: Any repair, resizing, or alteration performed by a third party other than JATUAL or an authorized partner will immediately void this warranty.
- Loss or Theft: This warranty is not an insurance policy and does not cover the loss, theft, or mysterious disappearance of the product.
C. Statutory Legal Warranties
Independent of the JATUAL PARIS International Guarantee, you are entitled to statutory legal rights under the applicable consumer laws of your country of residence:
- Legal Guarantee of Conformity: Covers products that are not as described or fit for purpose.
- Guarantee Against Hidden Defects: Covers latent defects that render the product unfit for use.
Note for EU Customers: These rights apply automatically and are not limited by our commercial warranty.
D. How to Make a Claim
To initiate a warranty claim, you must contact the Client Relations Center. You will be required to provide:
- The original Proof of Purchase (invoice or sales receipt).
- The Warranty Card (dated, stamped, and signed at the time of purchase).
- The product for physical inspection by our Quality Control team.
8. Limitation of Liability
To the fullest extent permitted by applicable law, our aggregate liability to you under these Conditions of Sale for any order whether in contract, tort (including negligence) or otherwise, shall in no event exceed one hundred percent (100%) of the price of the Product(s) in your order. We are not liable for indirect or consequential damages.
9. Governing Law and Disputes
- For sales via SDS Group s.r.o.: These Conditions of Sale shall be governed by and construed in accordance with the laws of Slovakia.
- For sales via JATUAL DIAMONDS DMCC: These Conditions of Sale shall be governed by and construed in accordance with the laws of the United Arab Emirates as applicable in the Emirate of Dubai.
10. Force Majeure (Events Outside Our Control)
10.1 Definition
We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Conditions of Sale that is caused by an act or event beyond our reasonable control ("Force Majeure Event").
A Force Majeure Event includes, but is not limited to: strikes, lock-outs, or other industrial action; civil commotion, riot, invasion, terrorist attack or threat of terrorist attack; war (whether declared or not) or threat or preparation for war; fire, explosion, storm, flood, earthquake, subsidence, epidemic, pandemic, or other natural disaster; or failure of public or private telecommunications networks; or impossibility of the use of railways, shipping, aircraft, motor transport, or other means of public or private transport.
10.2 Consequences of Force Majeure
If a Force Majeure Event takes place that affects the performance of our obligations under these Conditions of Sale:
- We will contact you as soon as reasonably possible to notify you; and
- Our obligations under these Conditions of Sale will be suspended and the time for performance of our obligations will be extended for the duration of the Force Majeure Event.
10.3 Right to Cancel
Where the Force Majeure Event affects our delivery of Products to you, we will arrange a new delivery date with you after the Force Majeure Event is over. If the Force Majeure Event persists for more than thirty (30) days, you may contact us to end the contract. If you opt to cancel, we will refund the price you have paid, including any delivery charges, for any Products you have not received.
